15.1 unlawful carrying of firearms1

  17. Though this is a violent crime under 57 O.S.2021, § 571(2), the enhanced penalty for second or subsequent violations of the statute itself is 10 to 30 years imprisonment. Commission of this crime after any other prior felony conviction would result in a sentence of 10 years to life imprisonment; and after 2 prior felony convictions the penalty is 20 years to life imprisonment. 21 O.S.2021, § 51.1(A)(1), (B). The Legislature’s treatment of those who repeatedly use firearms in violation of this statute more favorably than those who violate the statute after 1 or more other felony convictions is perplexing, to say the least. ↩︎
